These Terms of Service ("Terms") form a contract between you and Hansoft Industries Ltd, Sittingbourne, Kent, United Kingdom ("we", "us", "MachineSafe") for your use of the MachineSafe Compliance Suite at machinesafe.org (the "Service"), including the ISO 12100, EHSR, electrical, guarding, control-system, safety-distances, noise/vibration/EMC, cybersecurity and Technical File tools, AI drafts and the AI assistant. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
MachineSafe provides cloud-based machinery-safety assessment tooling for machine builders, supporting CE/UKCA marking workflows. Plans:
Plan features, machine limits and AI generation quotas are as shown on the pricing page at the time of purchase. We may improve or modify features; material reductions to paid plans will be notified in advance under section 12.
You must be at least 18 years old and legally able to enter contracts. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us promptly at info@machinesafe.org of any suspected compromise.
Payments are processed securely by Stripe; we never see or store your card details. Prices are shown including or excluding VAT as indicated at checkout (VAT is calculated by Stripe Tax where applicable).
Monthly subscriptions are non-refundable once the billing period has started, except where required by law or at our discretion. If you are a UK/EU consumer purchasing digital content, you have a 14-day right of withdrawal; by starting a paid subscription immediately you expressly consent to immediate supply and acknowledge the right lapses once supply begins in full. Contact us within 14 days if you believe you qualify for an exception.
You must not: misuse the Service, attempt to access other users' data, circumvent plan limits or metering, abuse AI endpoints (including automated bulk generation), upload unlawful content, or use outputs to misrepresent the compliance status of machinery. We may rate-limit, suspend or terminate accounts that breach this section.
AI drafts and the assistant assist competent persons; they do not replace professional judgement, testing, or legal advice. AI output may be incomplete or incorrect. You remain solely responsible for verifying every assessment, for compliance with the EU Machinery Directive / Machinery Regulation (EU) 2023/1230, the UK Supply of Machinery (Safety) Regulations, and all applicable harmonised/designated standards in your jurisdiction. Always involve qualified machinery-safety professionals for safety-critical decisions.
You retain ownership of the machine data and assessments you create. You grant us a licence to host and process that content solely to operate the Service. The Service itself — software, prompts, design and branding — remains our property or that of our licensors. Do not copy, reverse engineer or resell it.
We aim for high availability but give no uptime warranty. The Service may be interrupted for maintenance, supplier outages (hosting, auth, payments, AI providers) or events beyond our control. AI features depend on third-party model availability and monthly generation quotas.
Nothing in these Terms limits liability that cannot be limited by law (including death or personal injury caused by negligence, fraud, or consumer rights). Subject to that, to the maximum extent permitted by law: (a) we are not liable for indirect or consequential loss, loss of profit, or loss of data; (b) our total liability arising from the Service is capped at the subscription fees you paid in the 12 months before the claim. The Free plan is provided "as is" without warranties.
You may close your account anytime via the Customer Portal or by contacting us; paid access continues to the end of the billing period. We may suspend or terminate for breach, non-payment or abuse, with reasonable notice where practicable. On termination your data is retained for a reasonable export window unless deletion is requested or legally required.
We may update these Terms; material changes will be notified by email or in-app notice at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to mandatory consumer rights in your home jurisdiction.
